Terms of Service

The following are the terms and conditions for use of Micro EMS's services. Please read them carefully. Our service is offered to you with the condition that you accept without modification the terms and conditions contained herein. Micro EMS may change these Terms of Service at any time, with or without notice. Accordingly, you should return to this Website often to check for changes to the Terms of Services. You understand that by using the service after a change becomes effective, you have agreed to it. By selecting services from Micro EMS, you are indicating your agreement to be bound by all of the terms and conditions set forth in this document.

THESE TERMS AND CONDITIONS STATE IMPORTANT REQUIREMENTS REGARDING YOUR USE OF MICRO EMS'S COMPUTER SUPPORT SERVICE AND YOUR RELATIONSHIP WITH MICRO EMS . YOU SHOULD READ THEM CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OURS.

GENERAL

These Terms of Service (the "Agreement") are entered into by and between you, the customer (personally and/or on behalf of your employer, as applicable) ("you", "your" or "Subscriber") and Micro EMS. ("Micro EMS", "us" or "we"). You are deemed to have accepted this Agreement upon the earlier of: (i) your submission of an online or telephone request for service; (ii) your accepting the Terms of Service electronically during registration or in the course of initiating a support session whether online, by telephone or on-site; or (iii) your use of the Service. This Agreement is made up of the terms below, plus the Privacy Policy, all attachments to this Agreement, and the other policies and materials specifically referred to in these Terms of Service, all of which are incorporated herein by reference. The Agreement and related policies are also set forth on the Micro EMS website (www.MicroEMS.net) ("Website"). The Agreement sets forth the terms and conditions under which you agree to use the Service, and under which Micro EMS agrees to provide the Service to you. 2. DEFINITION OF SERVICE

For purposes of this Agreement, the term "service" shall mean the Micro EMS services, including all technical support provided by Micro EMS under the service option that you have selected. The Service may be referred to as, "Remote Computer Repair", "Online Computer Repair", "Remote Technical Support", "Online Technical Support" or "Micro EMS", "Online Computer Repair Services".

3. PRICING AND PAYMENTS

Micro EMS's fees and charges for the service you select are provided to you during the ordering process and are available on the Micro EMS web site unless otherwise provided for in this Agreement. You agree to pay the charges applicable to your selected service plan, as well as any, applicable taxes and other charges including but not limited to initial and monthly fees. You also agree to pay any additional charges or fees applied to your billing account for any reason, including but not limited to, interest, and charges due to insufficient credit or insufficient funds.

3.1. Micro EMS will make every reasonable attempt to troubleshoot, analyze, assess, correct or otherwise fix your computer or network problem. If Micro EMS is unable to resolve your computer problem, you will not be charged or a refund will be given.

3.2. All payments are expected to be collected at the beginning of the Online Computer Repair call. The technician will calculate the total amount due based on the fixed rate. Upon completing the repairs, the technicians will explain to the customer what has been done and demonstrate that the problem described by the customer prior to the start of the repairs has been fixed.

3.3. Credit Cards are accepted as forms of payments. Credit Card payments will be processed through online PAYPAL service.

3.4. If the problem cannot be repaired online and requires that the technician to schedule a pick up and drop off repair (Northeast Atlanta only), then the customer is expected to make the payment for the initial onsite visit as calculated by the technician. A flat rate fee will be calculated for the follow up repair work.

3.5. If a technician discovers an un-foreseen computer problem which requires additional cost to fix and the customer declines the repairs, the payment for the pick-up service call is expected as calculated by the technician using the hourly rate or the fixed rate.

4. WARRANTIES

4.1. There are no warranties for computer repair that involve software issues, virus problems and spyware problems. Upon the completion of the repair, the technician will demonstrate to the customer that the problem has been fixed. Any subsequent calls regarding software, virus, and/or spyware related problems will be charged as a new online or pick-up service call (Northeast Atlanta only).

4.2. Repair work involving hardware carries a 10 day warranty from Micro EMS. Furthermore, the individual hardware components carry their own warranty from the manufacturer and will be replaced or fixed by Micro EMS should they fail to operate properly.

4.3 Networking installations and upgrades come with a 10 day warranty during which Micro EMS will first troubleshoot the problem by phone or online with a customer. If the problem cannot be fixed over the phone or online, Micro EMS will make an onsite visit (Northeast Atlanta only) free of charge and deal with the problem accordingly.

4.4. In the event that our technician is not able to determine what the problem is during the visit there will be no fees associated with the onsite visit (Northeast Atlanta only). This provision does not include the instances where the technician knows what the problem is but cannot repair it onsite during the initial visit and requires a follow up visit or that the PC be taken to the Micro EMS computer repair shop.

5. SCOPE OF SUPPORT

In the event that our technician makes an Onsite Repair or Pick-up (Northeast Atlanta only) but the problem cannot be resolved because the issue is outside the scope of our support and needs to be handled by the computer manufacturer, an outside vendor, or another provider an Onsite Repair or Pick-up service fee is still required. The onsite technician will attempt to contact the company/vendor/person who will handle and/or escalate the issue. This provision includes but is not limited to (i) dealing with Internet Connection problems where it is determined that the cause of the problem is not the computer but a networking component supported by the internet service provider, (ii) licensed software or hardware issues that must be handled by the computer or product manufacturer if the product is under warranty, (iii) any other 3rd party specialized software/hardware not listed above.

6. LIMITATION ON LIABILITY

IN NO EVENT SHALL MICRO EMS AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHER SIMILAR DAMAGES OR ANY DAMAGES RESULTING FROM LOSS OF USE, OR LOSS OF DATA, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF MATERIALS AVAILABLE FROM THE SITE, EVEN IF THE POSSIBILITY OF SUCH DAMAGES COULD HAVE BEEN FORESEEN BY MICRO EMS.

BACKING UP DATA

BACKUP YOUR SOFTWARE AND DATA: IT IS YOUR RESPONSIBILITY TO BACK UP ALL SOFTWARE AND DATA THAT IS STORED ON YOUR COMPUTER'S HARD DISK DRIVE(S) AND/OR ON ANY OTHER STORAGE DEVICES YOU MAY HAVE PRIOR TO SERVICE PERFORMED ON YOUR HOME OR BUSINESS COMPUTER. MICRO EMS AND/OR ITS THIRD PARTY SERVICE PROVIDER SHALL NOT BE RESPONSIBLE AT ANY TIME FOR ANY LOSS, ALTERATION OR CORRUPTION OF ANY SOFTWARE, DATA OR FILES.
